Terms & Conditions
This agreement (“Agreement”) is made and entered into by and between Valley Self Storage & Warehousing Ltd., hereinafter referred to as “Valley Self Storage,” and the individual or entity renting storage space, hereinafter referred to as “Customer.”
This Agreement governs the terms and conditions of the rental of self-storage space at Valley Self Storage & Warehousing Ltd., at 1297 Ridge Road, Wolfville Ridge, Nova Scotia B4P 2R1.
1) Locker Usage
- The storage unit provided by Valley Self Storage is intended for the storage of lawful items in a safe and secure manner, and for storage purposes ONLY.
- Any other uses of the storage unit will result in immediate termination of the Agreement.
- Prohibited items include hazardous materials, perishable goods, live animals, illegal substances, firearms, explosives, or any item deemed unsafe or unlawful.
- Modifications to the storage unit are strictly prohibited.
2) Rental Period
- The standard rental period will run from the 1st day of each month to the last, or one month.
- This Agreement will be in effect from the date initial payment is received to the last day of the month, at which time occupancy will either be terminated or extended.
- Monthly rental fees grant the Customer access to storage units for that month only.
- Consecutive monthly rental payments are required to maintain access to a unit for multiple rental periods, or months.
- Rental fees charged for a rental period shorter than one month will be pro-rated. Customers renting a unit after the first day of the month will only be charged to the end of the month.
3) Termination
- Upon termination of the Agreement, the Customer must relinquish control of the unit back to Valley Self Storage. Vacated units must be emptied, cleaned and free from damage (other than normal wear-and-tear). Customers are responsible for leaving their unit ready for the next tenant.
- Once the Customer vacates their unit, they are responsible for contacting Valley Self Storage by call, text or email, to request an inspection of the vacated unit.
- Units must be vacated prior to the final day of the month, with notice given to Valley Self Storage. If the locker is not vacant (emptied, clean and ready for next tenant), an additional month’s rent will be charged, and the rental agreement will extend for another period.
- Customers may voluntarily terminate the rental period prior to the end of the rental period; however, no refunds will be issued if the Customer leaves early.
- Valley Self Storage reserves the right to terminate the agreement without notice to the Customer, in event that the rental agreement is breached by the Customer.
4) Locks and Security
- Customers are responsible for bringing their own locks for their units. Once a locker is rented, Valley Self Storage will remove their lock, and require the Customer to use a lock of their own choosing.
- Customers are responsible for ensuring the security of their belongings by properly securing the unit with their own lock.
- Customers are permitted to use one lock only, to secure their unit. While door latches have space for two locks, Valley Self Storage reserves the right to place its own lock in the second space, in event of a breach of rental agreement.
- Additional security measures are in place at the facility, including 24/7 site surveillance and staff monitoring. Customers accept that these additional security measures are only effective when a unit is securely locked by the customer.
5) Insurance
- Valley Self Storage does not provide insurance to customers for stored items.
- Valley Self Storage assumes no liability for items stored in your respective unit.
- Customers are encouraged to obtain insurance coverage for their stored belongings. We suggest customers ask their home insurance providers about additional insurance for their storage unit. Home insurance policies will sometimes cover stored belongings automatically.
6) Door and Lane Clearance
- Customers must ensure that stored items do not obstruct access to the unit or interfere with the operation of doors.
- Customers must ensure they are not blocking their lane or other units with their vehicles, trailers, or items to be stored, especially while moving in or out of their units.
7) Cleaning Fee and Damages
- Customers must ensure that vacated units are empty, clean and free from damage.
- After the Customer vacates the unit, Valley Self Storage will inspect the unit.
- If a reasonable effort has not been made to clean the unit and leave it in its original state, a $50.00 cleaning fee will be charged to have us finish cleaning the unit.
- Any damages to our property will result in additional fees to repair said damages.
8) Lock-Cut Fee
- As customers are responsible for the lock on their unit, Valley Self Storage will not be able to unlock your unit. You will be responsible for your own key (or keycode).
- Customers agree to a $30.00 lock-cut fee, if the customer requires assistance to regain access of their unit. This may happen for several reasons, not limited to, misplaced key, broken key or forgotten keycode, and will require a lock cut.
9) Lien on Stored Goods
- Valley Self Storage shall have a lien on stored goods for unpaid charges, including storage fees and other expenses incurred.
- Valley Self Storage may enforce its lien rights in accordance with the Warehousemen’s Lien Act.
10) Payment Terms and Late Payments
- All locker rental fees are due on the 1st day of each month.
- Credit cards must be used for payment, unless otherwise discussed and approved.
- A $10.00 late fee will be charged for payments not received by the due date.
- If payment is not received within two weeks (14 days) of the due date, Valley Self Storage reserves the right to lock the respective unit. A $25.00 no payment fee will be charged after 14 days, and the unit will remain locked until all outstanding fees are paid.
11) Uncollected Payment and Legal Action
- In addition to any other remedies provided by law, the Valley Self Storage may take necessary action to enforce the terms of this Agreement, including the removal of stored items for non-payment.
- If payment is still not received within 28 days following the due date, Valley Self Storage is entitled to take possession of the stored items. Once Valley Self Storage takes possession of the stored items, Valley Self Storage will put the unit up for auction.
- In this event the additional $30.00 lock-cut fee will be charged to regain control of the unit.
- Partial payments will not prevent late fees or legal action. Outstanding fees must be paid in full to ensure full compliance with the rental agreement.
12) Fee Increases
- Valley Self Storage reserves the right to increase rates, provided sufficient notice is given to the Customer.
- Customers will be notified in writing of any fee increases, sixty (60) days prior to the rate increase taking effect.
- If occupancy of storage facilities extends past the 60-day notice period, the rate changes will automatically take effect.
13) Online Account Management
- Valley Self Storage uses its website as its management platform for its storage facilities. Customers are expected to create an account and manage their locker subscription online.
- Creating an account allows customers to add additional payment methods, purchase additional locker subscriptions and make changes to personal information.
- Customers are responsible for keeping online accounts up to date with accurate information, especially contact details.
14) Emergencies and Inspection
- In case of emergencies or maintenance issues, Valley Self Storage reserves the right to access the storage unit without prior notice.
- Routine inspections may be conducted by Valley Self Storage to ensure compliance with this Agreement.
15) Subletting
- Subletting of the storage unit is strictly prohibited without prior written consent from Valley Self Storage.
- Any evidence of subletting will be investigated. If subletting is found to be taking place without the consent of Valley Self Storage, the rental agreement will be terminated immediately.
16) Contract Waivers and Altercations
- No waiver of any provision of this Agreement shall be granted.
- Alterations or modifications to this Agreement must be made in writing and signed by both parties.
17) Parties Bound by Agreement
- This Agreement binds the Customer, their agents, and the Facility and their respective heirs, successors, and assigns.
18) Governing Law
- This Agreement shall be governed by and construed in accordance with the laws of Nova Scotia, and in accordance with the Warehousemen’s Lien Act.
